Terms & Conditions

These Terms and Conditions govern access to and use of this website, registration for the Summer Camp program advertised on this website, and participation in the Camp. By accessing or using the website, submitting any registration or inquiry, making any payment, or permitting a child to attend or participate in the Camp, the parent or legal guardian agrees to be bound by these Terms and Conditions.

1. Definitions

For the purposes of these Terms and Conditions:

  • 1.1 "Camp" means the Summer Camp program described on this website and in any related official materials.
  • 1.2 "Organizers" means Hai Ba Trung School, Shattuck-St. Mary's, and Binh Duong Investment Company, cooperating in relation to the planning, support, promotion, and operation of the Camp.
  • 1.3 "Shattuck-St. Mary's" means Shattuck-St. Mary's, in its capacity as a cooperating party in relation to the Camp, and includes its trustees, directors, officers, employees, faculty, staff, contractors, agents, representatives, volunteers, affiliates, successors, and assigns.
  • 1.4 "Camp Administration" means the persons or entities designated from time to time by the Organizers to administer registration, communication, payment handling, participant records, local logistics, scheduling, direct supervision, transportation coordination, boarding coordination, staffing coordination, and day to day Camp operations.
  • 1.5 "Participant" means any student registered for, enrolled in, or attending the Camp.
  • 1.6 "Parent" means the parent, legal guardian, or other person lawfully authorized to act on behalf of the Participant.
  • 1.7 "Website" means this Camp website and all associated pages, forms, content, functionality, domains, and related digital services.
  • 1.8 "Website Developer" means Tri Design Labs, together with its officers, employees, contractors, agents, representatives, successors, and assigns, in its capacity as the designer, builder, operator, maintainer, host, technical administrator, or website service provider in relation to the Website.

2. Organizing Parties and Allocation of Responsibility

  • 2.1 The Camp is conducted through a cooperation among Hai Ba Trung Creative Experience Center, and Binh Duong International Investment JSC (BDI) in collaboration with SSM US.
  • 2.2 For the avoidance of doubt, the Camp is not run directly by Shattuck-St. Mary's International School.
  • 2.3 Any reference on this Website or in any promotional, informational, or registration material to Shattuck-St. Mary's shall not be construed as a representation that the Camp is operated by Shattuck-St. Mary's International School, nor as a representation that Shattuck-St. Mary's acting alone is solely or directly responsible for every aspect of Camp administration, local operations, payments, transportation, boarding, participant supervision, medical response, or website operation.
  • 2.4 Unless expressly stated otherwise in writing, direct administration and day to day operational matters may be carried out by the Camp Administration and relevant local service providers designated by the Organizers.
  • 2.5 Nothing in these Terms and Conditions shall be interpreted as creating any partnership, joint venture, fiduciary duty, school enrollment relationship, or agency relationship beyond the stated cooperative arrangement, nor as creating any assumption by Shattuck-St. Mary's of a duty, obligation, or liability except to the extent expressly undertaken by it in writing or imposed by non-excludable law.

3. Acceptance of Terms

  • 3.1 By registering a Participant for the Camp, the Parent represents and warrants that they have full legal authority to act on behalf of the Participant and to accept these Terms and Conditions.
  • 3.2 Access to or use of the Website, submission of any form, payment of any deposit or fee, or attendance at the Camp shall constitute full and unconditional acceptance of these Terms and Conditions, as amended from time to time.

4. Enrollment and Admission

  • 4.1 Enrollment in the Camp is subject to availability and to the age, grade, health, behavioral, and other eligibility requirements published by the Camp Administration.
  • 4.2 Submission of an application, inquiry, expression of interest, or payment does not guarantee admission. A place shall be confirmed only upon written confirmation from the Camp Administration and receipt of any required deposit or fee.
  • 4.3 The Organizers reserve the right, in their sole but reasonable discretion, to refuse, suspend, cancel, or terminate any registration or participation where a Participant's needs, conduct, medical condition, legal status, or other relevant circumstances cannot be appropriately accommodated within the scope, staffing, supervision, safety, or operational framework of the Camp.

5. Registration Information and Disclosure

  • 5.1 The Parent shall provide complete, accurate, and current information in connection with registration, including all information reasonably required for the safe and proper participation of the Participant, including medical information, allergies, medication needs, dietary restrictions, behavioral concerns, educational support needs, emergency contact details, passport or travel details where applicable, and any other relevant matter.
  • 5.2 The Parent shall promptly notify the Camp Administration in writing of any change to such information.
  • 5.3 The Organizers, Shattuck-St. Mary's, the Camp Administration, and the Website Developer shall be entitled to rely upon information submitted through the Website or otherwise provided by the Parent, and shall not be liable for any loss, injury, damage, delay, communication failure, processing issue, data issue, or adverse consequence arising from incomplete, inaccurate, misleading, or untimely disclosure.

6. Fees, Deposit, and Payment

  • 6.1 All tuition, boarding fees, transportation fees, activity fees, supplemental charges, and other amounts payable in relation to the Camp shall be as published on the Website or otherwise communicated in writing by the Camp Administration.
  • 6.2 A deposit may be required to reserve a Participant's place. Unless expressly stated otherwise in writing, all deposits are non-refundable.
  • 6.3 All fees must be paid in full by the stated deadline. Failure to pay any amount by the applicable due date may result in cancellation of the registration without further liability on the part of Shattuck-St. Mary's, the Organizers, the Camp Administration, or the Website Developer.
  • 6.4 Any bank fees, remittance charges, taxes, currency conversion costs, card fees, or transfer costs shall be borne solely by the Parent unless expressly stated otherwise.

7. Discounts and Promotional Offers

  • 7.1 Any early registration discount, sibling discount, referral incentive, promotional rate, scholarship, rebate, or other special offer shall apply only in accordance with its stated terms.
  • 7.2 Unless expressly stated otherwise in writing, discounts and promotional offers may not be combined.
  • 7.3 The Organizers reserve the right to amend, withdraw, suspend, or reject any discount or promotional offer at any time prior to final confirmation of enrollment and receipt of full payment.

8. Cancellation and Withdrawal by Parent

  • 8.1 Any request to cancel or withdraw a Participant must be submitted in writing by the Parent.
  • 8.2 Unless otherwise expressly agreed in writing, deposits are non-refundable, and any refund of fees paid shall be governed solely by the applicable published refund policy, if any.
  • 8.3 No refund shall be due in respect of non-attendance, late arrival, early departure, voluntary withdrawal, illness, injury, visa refusal, travel disruption, family decision, scheduling conflict, disciplinary removal, or any other circumstance not resulting from cancellation of the Camp by the Organizers, except as may be required by applicable law.
  • 8.4 The Organizers may deduct any administrative, banking, staffing, reservation, processing, third-party service, or other reasonable costs incurred in connection with any cancellation or withdrawal.

9. Changes, Suspension, or Cancellation by the Organizers

  • 9.1 The Organizers reserve the right, at any time and where reasonably necessary, to alter, amend, substitute, postpone, shorten, extend, relocate, combine, suspend, or cancel the Camp or any part of it, including schedules, activities, venues, staffing arrangements, boarding arrangements, transportation arrangements, facilities, service providers, or program content.
  • 9.2 Such action may be taken for reasons including insufficient enrollment, operational requirements, staffing issues, health or safety concerns, adverse weather, force majeure, facility unavailability, governmental directives, public health events, legal or regulatory requirements, or any circumstance beyond the reasonable control of the Organizers.
  • 9.3 Where the Camp is cancelled in its entirety prior to commencement and no suitable alternative is offered, any refund shall be limited to the amount, if any, required by the applicable refund policy or mandatory law.
  • 9.4 To the fullest extent permitted by law, Shattuck-St. Mary's, the Organizers, the Camp Administration, and the Website Developer shall not be liable for any indirect, incidental, special, or consequential loss, including travel costs, accommodation costs, visa costs, loss of opportunity, loss of use, or other related expenses.

10. Participant Conduct and Discipline

  • 10.1 The Participant shall comply with all Camp rules, policies, health and safety requirements, behavioral expectations, and instructions issued by the Camp Administration or Camp staff.
  • 10.2 The Organizers reserve the right to remove a Participant from any activity, require collection by the Parent, suspend participation, or terminate enrollment where the Participant's conduct is considered unsafe, disruptive, abusive, aggressive, unlawful, inappropriate, or otherwise materially inconsistent with the welfare or orderly operation of the Camp.
  • 10.3 In the event of suspension, dismissal, or removal for disciplinary reasons, no refund shall be due unless required by law.

11. Health, Medical Treatment, and Emergency Action

  • 11.1 By registering a Participant, the Parent represents and warrants that the Participant is medically fit to participate in the Camp except as specifically disclosed in writing.
  • 11.2 The Parent shall disclose all relevant medical, physical, psychological, developmental, or behavioral conditions, together with any allergies, medications, restrictions, or support needs.
  • 11.3 In the event of illness, injury, accident, or emergency affecting the Participant, the Organizers or the Camp Administration may take such action as they reasonably consider necessary, including the provision of first aid, contact with emergency services, hospital treatment, urgent medical intervention by qualified professionals, and contact with the Parent or emergency contact.
  • 11.4 The Parent authorizes such action and agrees to bear all resulting medical, hospital, ambulance, pharmaceutical, transportation, and related costs.
  • 11.5 The Organizers reserve the right to restrict or deny participation in any activity on medical, behavioral, or safety grounds.

12. Medication

  • 12.1 No Participant may carry, possess, use, or self-administer medication except with the prior approval of the Camp Administration.
  • 12.2 Any medication provided to the Camp must be clearly labeled and accompanied by written instructions. The Organizers may require additional supporting documentation before accepting responsibility for the storage or administration of medication.

13. Supervision and Scope of Responsibility

  • 13.1 Reasonable supervision shall be provided only during designated Camp hours and in connection with official Camp activities.
  • 13.2 Unless expressly stated otherwise in writing, Shattuck-St. Mary's shall not, merely by virtue of being a cooperating party to the Camp, be deemed to have assumed direct, continuous, or individual custody, supervision, transportation responsibility, boarding responsibility, or medical responsibility for any Participant at all times.
  • 13.3 The Organizers and Camp Administration shall have no responsibility for the Participant before official check-in, after official check-out, during unauthorized absence, during personal travel arranged by the Parent, or during any period in which the Participant is not under the direct supervision of authorized Camp personnel.
  • 13.4 Where boarding, transportation, excursions, evening programming, or other additional services are provided, supplementary rules or waivers may apply and shall form part of these Terms and Conditions upon notice to the Parent.

14. Activities, Transportation, and Off-Site Programs

  • 14.1 Participation in sports, swimming, golf, laboratory activities, maker activities, excursions, field trips, transportation services, and other off-site or higher-risk activities may be subject to additional safety rules and instructions.
  • 14.2 The Parent acknowledges that such activities involve inherent risks, including the risk of bodily injury, delay, property loss, weather-related issues, traffic incidents, equipment failure, site conditions, and the acts or omissions of third parties.
  • 14.3 Unless the Parent has expressly declined such participation in writing and such declination has been accepted by the Camp Administration, the Parent authorizes the Participant to take part in such activities.
  • 14.4 To the fullest extent permitted by law, Shattuck-St. Mary's shall not be liable for the acts, omissions, delays, failures, or defaults of third-party carriers, venue operators, medical providers, security providers, accommodation providers, activity vendors, or other third-party service providers.

15. Assumption of Risk

  • 15.1 The Parent acknowledges and accepts that participation in the Camp involves inherent and ordinary risks associated with educational, recreational, athletic, residential, aquatic, travel-related, and group activities.
  • 15.2 By enrolling the Participant, the Parent knowingly assumes such risks on behalf of the Participant, except to the extent that liability cannot lawfully be excluded or limited.

16. Personal Property

  • 16.1 The Participant is solely responsible for all personal belongings brought to the Camp, including clothing, electronic devices, documents, cash, luggage, jewelry, and other valuables.
  • 16.2 To the fullest extent permitted by law, Shattuck-St. Mary's, the Organizers, the Camp Administration, and the Website Developer shall not be liable for any loss, theft, destruction, or damage to personal property unless directly caused by wilful misconduct or other liability that cannot lawfully be excluded.

17. Photographs, Recordings, and Student Work

  • 17.1 The Organizers may photograph, film, record, reproduce, publish, display, or otherwise use the Participant's image, voice, likeness, statements, and work product for educational, administrative, archival, promotional, marketing, and public communication purposes, including use on websites, social media, brochures, reports, and presentations.
  • 17.2 By registering for the Camp, the Parent grants consent to such use unless written notice refusing such consent is submitted prior to the commencement of the Camp and acknowledged by the Camp Administration.
  • 17.3 The Parent acknowledges that, in the context of group activities, complete exclusion from photographs or recordings may not always be reasonably practicable.

18. Data Protection and Privacy

  • 18.1 The Organizers, Shattuck-St. Mary's, the Camp Administration, and the Website Developer may collect, use, store, process, transmit, and disclose personal data relating to the Participant and Parent as reasonably necessary for registration, payment processing, communication, website administration, form handling, health and safety management, transportation, accommodation, supervision, emergency response, insurance, legal compliance, record-keeping, security, fraud prevention, and the general administration of the Camp.
  • 18.2 Such data may be disclosed to service providers, medical providers, transport providers, hosting providers, form processors, payment processors, insurers, regulatory authorities, cooperating institutions, or other relevant parties where reasonably necessary for the operation of the Camp or as required by law.
  • 18.3 By registering for the Camp or using the Website, the Parent consents to such collection, use, processing, storage, transmission, and disclosure.

19. Website Use

  • 19.1 The Website is provided for informational and registration purposes only. The Parent and any user of the Website shall use the Website lawfully and shall not misuse, disrupt, interfere with, attempt to gain unauthorized access to, reverse engineer, scrape, overload, transmit malicious code to, or otherwise compromise the Website or any related service, server, form, database, or digital infrastructure.
  • 19.2 The Parent further agrees not to submit false, misleading, unlawful, defamatory, infringing, abusive, or harmful content through any contact form, enrollment form, inquiry form, or other Website functionality.
  • 19.3 Shattuck-St. Mary's shall not be liable for website misuse by any user or for content submitted by the Parent, Participant, or third parties.
  • 19.4 The Organizers, the Camp Administration, and the Website Developer reserve the right to suspend, restrict, block, delete, preserve, review, or disclose submissions or technical access where reasonably necessary for security, maintenance, legal compliance, abuse prevention, or operational purposes.

20. Website Availability, Technical Disclaimer, and Third-Party Services

  • 20.1 The Website is made available on an as-is and as-available basis. While reasonable efforts may be made to maintain accuracy, functionality, and availability, no representation or warranty is given that the Website will be uninterrupted, error-free, secure, current, compatible with all devices, or free from bugs, viruses, or other harmful components.
  • 20.2 The Organizers, Shattuck-St. Mary's, the Camp Administration, and the Website Developer do not warrant that submissions made through the Website will always be received, processed, stored, routed, or delivered without delay, interruption, duplication, corruption, filtering, technical failure, cyber incident, or third-party service interruption.
  • 20.3 The Website may rely upon or contain links to third-party tools, hosting services, maps, forms, plugins, analytics services, payment channels, communication tools, or external websites. Shattuck-St. Mary's shall have no responsibility for the availability, content, privacy practices, functionality, or acts or omissions of such third parties.
  • 20.4 Use of any third-party service linked through or embedded in the Website shall be at the user's own risk and subject to the terms and policies of the relevant third party.

21. No Guarantee of Outcome, Admission, or Relationship

  • 21.1 While the Organizers shall use reasonable efforts to deliver the Camp substantially as described, no representation or warranty is given that any activity, staff member, schedule, venue, facility, or advertised component will be available exactly as described.
  • 21.2 Participation in the Camp does not guarantee any specific academic, athletic, linguistic, developmental, social, or admissions-related outcome.
  • 21.3 Participation in or inquiry about the Camp does not create any right, preference, priority, expectation, or entitlement with respect to admission, enrollment, recruitment, scholarship, placement, recommendation, endorsement, or future participation in any program associated with Shattuck-St. Mary's.
  • 21.4 Nothing in the Camp, the Website, or any promotional material shall be construed as creating a separate educational contract with Shattuck-St. Mary's beyond the terms expressly stated herein.
  • 21.5 The Website Developer does not guarantee any business outcome, enrollment result, lead generation result, conversion rate, uptime level, or performance outcome arising from the existence, operation, or use of the Website.

22. Limitation of Liability

  • 22.1 To the fullest extent permitted by applicable law, the aggregate liability of Shattuck-St. Mary's, whether arising in contract, tort, negligence, statutory duty, misrepresentation, restitution, equity, data claim, website claim, or otherwise, arising out of or in connection with the Camp or the Website, shall be excluded to the maximum extent permitted by law and, where exclusion is not permitted, shall in no event exceed the amount of Camp fees actually paid by the Parent for the relevant Participant.
  • 22.2 To the fullest extent permitted by applicable law, the aggregate liability of the Organizers, the Camp Administration, and the Website Developer arising out of or in connection with the Camp or the Website, whether in contract, tort, negligence, statutory duty, misrepresentation, data claim, technical service failure, or otherwise, shall not exceed the amount of Camp fees actually paid by the Parent for the relevant Participant.
  • 22.3 Where a claim relates solely to use of the Website and not to paid Camp participation, Shattuck-St. Mary's, the Organizers, the Camp Administration, and the Website Developer shall have no liability for any indirect, incidental, special, punitive, exemplary, or consequential loss or damage, including loss of data, loss of use, loss of opportunity, loss of profits, loss of business, loss of reputation, travel costs, accommodation costs, or personal expenses.
  • 22.4 The Website Developer shall not be liable for any claim arising from Camp content supplied by the Organizers or Camp Administration, from Parent-submitted data, from third-party services, or from events beyond its reasonable technical control.
  • 22.5 Nothing in these Terms and Conditions shall exclude or limit any liability that cannot lawfully be excluded or limited.

23. Indemnity and Hold Harmless

  • 23.1 The Parent agrees, to the fullest extent permitted by law, to indemnify, defend, release, and hold harmless Shattuck-St. Mary's, Hai Ba Trung School, Binh Duong Investment Company, the Camp Administration, Tri Design Labs, and each of their respective trustees, directors, officers, employees, faculty, staff, contractors, agents, representatives, volunteers, affiliates, successors, and assigns from and against any and all claims, demands, actions, proceedings, liabilities, losses, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable legal fees and professional costs, arising out of or in connection with:
    • (a) any breach of these Terms and Conditions by the Parent or Participant
    • (b) any inaccurate, incomplete, misleading, unlawful, or untimely information submitted by the Parent through the Website or otherwise
    • (c) any act or omission of the Participant causing loss, damage, injury, disruption, or expense to any person, property, system, activity, or service
    • (d) any misuse of the Website by the Parent, Participant, or any person acting on their behalf
    • (e) any claim relating to data, content, files, forms, messages, or materials submitted by the Parent through the Website
    • (f) any medical, behavioral, educational, psychological, or support need not properly disclosed in advance
    • (g) any claim brought by a third party arising from the Parent's or Participant's use of the Website, registration attempt, attendance at the Camp, participation in any Camp activity, or breach of law or applicable policy
    • (h) any claim arising from the acts, omissions, delays, or failures of third-party transport providers, accommodation providers, activity vendors, or other third-party service providers engaged in connection with the Camp, except to the extent caused directly by the gross negligence or wilful misconduct of the indemnified party
  • 23.2 This clause shall not apply to the extent that the relevant loss arises directly from the gross negligence, wilful misconduct, or other non-excludable liability of the indemnified party.

24. Intellectual Property and Website Content

  • 24.1 All text, graphics, branding, logos, layout, design elements, photographs, videos, downloadable materials, source code elements where applicable, and other content appearing on the Website, excluding third-party content where applicable, shall remain the property of the relevant owner and may not be copied, reproduced, republished, distributed, modified, scraped, framed, mirrored, reverse engineered, or commercially exploited without prior written consent.
  • 24.2 Nothing in these Terms and Conditions grants any user any ownership right, license, or proprietary interest in the Website or its content except for a limited, revocable, non-exclusive right to access the Website for personal, non-commercial informational and registration purposes.

25. Force Majeure

  • 25.1 None of Shattuck-St. Mary's, the Organizers, the Camp Administration, or the Website Developer shall be deemed to be in breach of these Terms and Conditions, nor liable for any delay, interruption, reduction, modification, suspension, cancellation, unavailability, data transmission failure, hosting outage, or technical service disruption where such event results from circumstances beyond reasonable control, including natural disaster, flood, storm, fire, epidemic, pandemic, public health emergency, war, terrorism, civil unrest, strike, labor shortage, power failure, internet failure, telecommunications failure, cyberattack, hosting interruption, transportation disruption, governmental action, regulatory restriction, closure order, facility unavailability, or failure of a third-party service provider.
  • 25.2 In any such event, the relevant party may take such action as it reasonably considers necessary, including modification, postponement, relocation, suspension, cancellation, temporary removal of Website functionality, or interruption of digital services, without further liability except as required by law.

26. Amendments

  • 26.1 The Camp Administration reserves the right to amend, revise, supplement, or replace these Terms and Conditions at any time.
  • 26.2 Any amended version shall take effect upon publication on the Website or upon written notice to the Parent, unless otherwise stated. Continued use of the Website or continued participation in the Camp after such publication or notice shall constitute acceptance of the amended Terms and Conditions.

27. Governing Law and Jurisdiction

  • 27.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Vietnam.
  • 27.2 Any dispute arising out of or in connection with these Terms and Conditions, the Camp, or the Website shall be subject to the jurisdiction of the competent courts of Vietnam, unless otherwise required by mandatory law.

28. Severability

  • 28.1 If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be deemed severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

29. Entire Agreement

  • 29.1 These Terms and Conditions, together with any registration form, refund policy, medical form, code of conduct, boarding rules, transportation rules, privacy notice, website notice, and other official Camp documents issued by the Camp Administration, constitute the entire agreement between the parties in relation to the Camp and the use of the Website.

30. Administrative Contact

  • 30.1 All inquiries relating to registration, fees, refunds, administration, and Camp operations shall be directed to the official Camp Administration contact stated on this Website.
  • 30.2 For the avoidance of doubt, the Camp is conducted through a cooperation among Hai Ba Trung School, Shattuck-St. Mary's, and Binh Duong Investment Company, and is not run by Shattuck-St. Mary's International School.
  • 30.3 The Website is designed, built, and operated by Tri Design Labs, but Tri Design Labs does not, by virtue of that role alone, assume responsibility for Camp delivery, student supervision, admissions decisions, participant care, transportation, boarding, or educational services.
